The most common divorce is a "no-fault" divorce, whereby the grounds for divorce are the irretrievable breakdown of the marriage. On this basis, a decree of divorce can be entered by the Court as early as Ninety days after the filing and service of a divorce complaint, if both parties consent. If they do not consent, a decree of divorce can be entered after the parties have been separated for a period of two years.

The division of martial assets and debts, termed "equitable distribution" can occur through the discretion of the Court or by agreement of the parties. Many factors are used by the Court in determining equitable distribution of marital property, including length of marriage, income of both parties, and health of both parties.
